RECOMMENDATION:
Recommendation Concerning the Amendment of Agreement for Professional Consulting Services (PD 14-15.022) - Patrick T. Johnson, Waste Services Department Director

That the Board take the following action concerning the Amendment of Agreement for Professional Consulting Services (PD 14-15.022) between Escambia County, Florida, and Jones Edmunds & Associates, Inc., for Perdido Landfill Section 5, Cell 1A:

A. Approve the Amendment of Agreement for Professional Consulting Services (PD 14-15.022) between Escambia County, Florida, and Jones Edmunds & Associates, Inc., for Perdido Landfill Section 5, Cell 1A for additional Construction Phase Services for the period of October 17, 2018, through December 31, 2018, in an amount not to exceed $252,340; 

B. Authorize the Acting County Administrator to sign the Amendment of Agreement; and

C. Authorize the execution of the necessary Change Order.

BACKGROUND:
Per Florida Administrative Code 62-701, the professional engineer responsible for landfill construction quality assurance shall provide signed, sealed final reports and record drawings to the Florida Department of Environmental Protection (FDEP) upon project completion.  Due to unplanned construction delays, additional costs for engineering professional services is required to complete landfill expansion project in accordance with FDEP requirements.  Original substantial completion of the project was scheduled for July, 2018.  Most current construction schedule has substantial completion scheduled for December, 2018.  The project is approximately 55% complete.

Professional Engineering Services provider, Jones Edmunds and Associates, Inc. (JEA), original budget contained contingencies for project delays.  However, a five-month delay was not anticipated in the construction services budget.  During the current construction process contractor has received two potential notices of default of the Agreement with the Board of County Commissioners.  Notices reference key construction components, (i.e. dewatering and protection of work), which directly impacted construction schedule.  Since receiving notices, contractor's performance has improved and project appears to be on track for substantial completion, December 2018.
BUDGETARY IMPACT:
Funding for this project is available in Fund 401, Solid Waste Fund, Cost Center 230315, (Solid Waste Projects), Object Code 36301 (Improvements other than Buildings)
LEGAL CONSIDERATIONS/SIGN-OFF:
Attorney Kristin Hual, has reviewed the Amendment to the Agreement for form and legal sufficiency. 
PERSONNEL:

POLICY/REQUIREMENT FOR BOARD ACTION:
The Agreement may be amended only by a written agreement signed by an authorized representative of each party. 
IMPLEMENTATION/COORDINATION:
The Amendment for Professional Consulting Services will be delivered to Jones Edumunds and Assoicates, Inc., and a Change Order requested, after the Clerk's Office  has completed its recording for the Board's Minutes.
