RECOMMENDATION:
5:32 p.m. Second of two Public Hearings to receive input on the designation of 128 Airport Boulevard and the 6200 Block of North Palafox as Brownfield Sites.

Recommendation:  That the Board take the following action concerning the designation of 128 Airport Boulevard, Pensacola, Florida 32503 (Property Reference Numbers 35-1S-30-9002-002-012 and 35-1S-30-9002-007-008), and the 6200 Block of North Palafox Highway, Pensacola, Florida 32503 (Property Reference Number 36-1S-30-9002-000-003) as brownfield sites for the purpose of economic development and environmental rehabilitation:

A. Hold the second of two Public Hearings to receive input; and

B. Adopt and authorize the Chairman to sign the Resolution designating each of the three properties as a brownfield site within the Oakfield Community Redevelopment Area.
BACKGROUND:
The primary goals of the Brownfield Redevelopment Act (BRA) are to reduce public health and environmental hazards on existing commercial and industrial sites that are abandoned or underused due to these hazards; create financial and regulatory incentives to encourage voluntary cleanup and redevelopment of sites; derive cleanup target levels and a process for obtaining a "No Further Action" letter using Risk-Based Corrective Action principles; and provide the opportunity for Environmental Equity and Justice. 

To qualify for the incentives offered through the BRA, a property must be officially designated a Brownfield via Resolution by the local governing entity. The applicants (owners) of all three properties are requesting the properties be designated as a brownfield in order to capture economic incentives offered through the State for voluntarily remediating existing environmental impacts on the subject properties. These sites meet the requirements as a brownfield as per Chapter 376.80 F.S. The applicants will not be requesting any local funding but will use the designation to apply for incentives available through the State Brownfield Redevelopment Program. 

Notes: 
1.  The first of two Public Hearings was held at 5:32 p.m., on October 18, 2018.
2.  Exhibit A-3 in the Resolution has been updated with complete legal description of property boundaries. Per Stephen G. West, Senior Assistant County Attorney, it is acceptable to replace the exhibit.
BUDGETARY IMPACT:
There is no budgetary impact to the County.
LEGAL CONSIDERATIONS/SIGN-OFF:
Stephen G. West, Senior Assistant County Attorney, has approved the Resolution as to form and legal sufficiency.
