RECOMMENDATION:
Recommendation Concerning Floridian Ditch Restoration/Godwin Lane Pit Regional Pond Project - Joy Jones, P.E., Public Works Department Director

That the Board authorize staff to negotiate with Esplanade Communities of Florida, LLC, to bring back to the Board an Agreement that would allow the proposed Embers Ridge Subdivision to use County-owned property for stormwater purposes, upon appropriate improvements and payment by Esplanade.

This project is located in Commission District 1.
BACKGROUND:
At the regularly scheduled board meeting on May 17, 2018, the board accepted donation of a 16.89-acre inactive borrow pit, located on the north side of Godwin Lane, adjacent to Escambia County’s Road Department field operations site on Mobile Highway, property reference number 25-1S-3306-000-000. The deed for the property was recorded into official records in OR Book 7916, Page 1769, and was accepted by the Board with the intention of converting it into a regional stormwater management facility and reclaiming any borrow pit resources for County use. 
  
On October 22, 2018, the County received a letter from David W. Fitzpatrick, PE, PA as the representative for Esplanade Communities of Florida, LLC (Esplanade) requesting Escambia County to consider allowing the Esplanade Developer to utilize the Godwin Borrow Pit for stormwater storage and treatment.

The developer/owner, Esplanade Communities of Florida, LLC, intends to develop a 60-lot single family subdivision, referenced as Embers Ridge subdivision, on property reference numbers 38-1S-31-1200-002-001 and 38-1S-31-1200-006-001, approximately 18.75 acres of vacant property, located on the south side of Godwin Lane, approximately 1500 linear feet west of the subject Godwin Lane borrow pit.
 
In lieu of an onsite subdivision stormwater pond, the Developer requests they be allowed to design and permit the pit and associated drainage infrastructure through regulating Agencies to convert the pit into a Regional Stormwater Facility for the County. Staff estimates this regional pond could serve a 210-acre drainage basin for the area and provide available stormwater capacity for other future developments within the area. 
  
Preliminary engineering estimates for design, permitting, and construction are approximately $462,000.00. Staff has identified $150,000.00 in LOST IV “Floridian Ditch Restoration/Godwin Lane Pit Regional Pond Project” and another $150,000.00 in LOST III from completed or otherwise funded projects that can be reallocated if approved by the Board. The developer/owner proposes to offer $175,000 toward this effort.  This total is the offset price of not building an onsite pond and gaining two lots to sell.
 
BUDGETARY IMPACT:

Staff has identified $150,000.00 in LOST IV “Floridian Ditch Restoration/Godwin Lane Pit Regional Pond Project” and another $150,000.00 in LOST III from completed or otherwise funded projects that can be reallocated if approved by the Board. The developer/owner proposes to offer $175,000 toward this effort.  This total is the offset price of not building an onsite pond and gaining two lots to sell.
LEGAL CONSIDERATIONS/SIGN-OFF:
The County Attorney’s Office will review all documents associtated with the agreement.

POLICY/REQUIREMENT FOR BOARD ACTION:
This recommendation is in compliance with the Code of Ordinance of Escambia County, FL, 1999, Chapter 46, Finance, Article II, Purchases and Contracts. Additionally, this action is consistent with Land Development Code Sec. 5-4.5 (a)(6) which encourages regional stormwater management systems. 
IMPLEMENTATION/COORDINATION:
Upon Board approval, the Engineering Division will coordinate with all involved parties.
