RECOMMENDATION:
Recommendation Concerning the Acquisition of Real Property Located at 2700 Silhouette Drive for the Bristol Park - Ashbury Hills Area Project - Joy Jones, P.E., Public Works Department Director

That the Board either approve, by super-majority vote or deny the following action:
 
A. Authorize the purchase of real property located at 2700 Silhouette Drive from John and Angela Russo, for the Bristol Park - Ashbury Hills Area Project, for the average of the county's highest appraised value of $365,000 and the owner's provided appraisal of $385,000, which equals $375,000;

B. Authorize County staff to draft the Contract for Sale and Purchase for the acquisition of real property (approximately 0.70 acres) located at 2700 Silhouette Drive, from John and Angela Russo, and to bring the executed Contract back before the Board; and 

C. Authorize the County Attorney's Office to prepare, and the Chairman or Vice Chairman to execute, subject to Legal review and sign-off, any documents necessary to complete the acquisition of this property without further action of the Board (if the purchase is approved).

This Property is located in Commission District 5.
BACKGROUND:
Meeting in regular session on December 8, 2016, the Board approved staff to pursue the acquisition of properties that are listed within the Hazard Mitigation Grant Program (HMGP) and located along Eleven Mile Creek.

Mr. and Mrs. Russo are willing to sell their property, located at 2700 Silhouette Drive, in Bristol Park Subdivision, located along Eleven Mile Creek.

According to the FEMA Hazard Mitigation Grant Program Homeowner Acquisition Fact Sheet, the property owners can appeal the county's appraisal if they believe it is not adequate. The appeal process does include a second appraisal for their home at their expense.

Funds spent toward this project, and in accordance with the guidelines, are eligible for reimbursement.

As the area has seen recent development, it was suggested by Arcadis (the company assisting Escambia County with the HGMP grant process) to get the remaining grant properties re-appraised. Mr. and Mrs. Russo's property is still considered part of the grant and is eligible for full acquisition reimbursement. Per county policy, which requires two appraisals when there is any value over $250,000, staff obtained two appraisals, which placed values of $365,000 and $350,000. Staff then made an offer to the Russos for $357,500, the average of the two appraisal amounts. The Russos chose to utilize the FEMA appeal process and obtained their own appraisal, which valued their property at $385,000. As part of their appeal process, they are asking the county to average the highest county-obtained appraisal with their owner-provided appraisal, for a purchase price of $375,000.
BUDGETARY IMPACT:
Funding is available in Fund 352, “LOST III,” Cost Center 210120, Object Code 56101, Project #16EN3595. Funds spent toward this project are eligible for reimbursement through the grant.
LEGAL CONSIDERATIONS/SIGN-OFF:
The Contract for Sale and Purchase will be reviewed and approved by Stephen West, Senior Assistant County Attorney. The County Attorney's Office will prepare the closing documents and conduct the closing for the purchase of this property.
PERSONNEL:
All work associated with this acquisition is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:
These actions are consistent with the provisions of Section 46-139 of the Escambia County Code of Ordinances.
IMPLEMENTATION/COORDINATION:
Upon Board approval, staff will maintain compliance with Section 46-139 of the Escambia County Code of Ordinances.
