RECOMMENDATION:
5:31 p.m. Public Hearing for consideration of the Petition to Vacate Surfview Drive, as petitioned by Ed Czmut, Paradise Isle Homeowners Association.

Recommendation:  That the Board take the following action regarding a Petition to Vacate Surfview Drive, Paradise Isle Subdivision:

A. Approve or deny the Petition to Vacate Surfview Drive, Paradise Isle Subdivision, (0.93 acres more or less), as petitioned by Ed Czmut, Paradise Isle Homeowners Association;

B. Accept the Hold Harmless Agreement;

C. Adopt the Resolution to Vacate; and 

D. Authorize the Chairman or Vice Chairman to accept the documents as of the day of delivery of the documents to the Chairman or Vice Chairman, and authorize the Chairman or Vice Chairman to execute them at that time.

This Petition to Vacate request is located in Commission District 2.
BACKGROUND:
Surfview Drive, a 66-foot right-of-way, the sole roadway located in Paradise Isle Subdivision, Plat Book 16, Page 58, begins at Johnson Beach Road and then heads north.  

The petitioner, Ed Czmut, Paradise Isle Homeowners Association, Inc., is requesting Escambia County to vacate Surfview Drive (0.93 acres more or less). During a special Paradise Isle Homeowners Association, Inc. meeting in March, a majority of the owners voted to enhance Paradise Isle as a private gated community. Per Mr. Czmut, all homeowners understand that future maintenance of infrastructure will be required by the Homeowners Association. 
 
Staff has reviewed the request and has no objections to the Petition to Vacate. Emergency access will need to be discussed with Emergency Services/Fire Rescue prior to gate installation. All utility companies have been contacted. AT&T, Cox, Emerald Coast Utilities Authority, Energy Services of Pensacola, and Gulf Power will need to retain an easement in the area to be vacated. Gulf Power also has light poles in the area.  

Notifications were sent to the surrounding property owners within a 500' radius of the area mentioned in the Petition to Vacate.
BUDGETARY IMPACT:

Indirect staff cost associated with the preparation of documents and recommendation.

LEGAL CONSIDERATIONS/SIGN-OFF:

N/A

PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:

Based on the Board’s Vacating, Abandoning, and Closing Existing Public Streets, Rights-of-Way, Alleyways, Roads, Highways, Other Places Used for Travel or Other Lands Dedicated for Public Use or Purposes, or Any Portions Thereof to Renounce and Disclaim Any Right of the County and The Public In and To Said Lands policy for closing, vacating and abandoning County owned property – Section III and Florida Statutes, Chapter 336.

IMPLEMENTATION/COORDINATION:

Upon Board approval of the Petition to Vacate, the necessary documents will be signed and it will be the responsibility of the Petitioner to have the documents recorded in the public record and to advertise the required public notifications.
