RECOMMENDATION:
Recommendation Concerning the United States Department of Homeland Security, Federal Emergency Management Agency, and Florida Division of Emergency Management Hazard Mitigation Grant Program for the Construction of the Lake Charlene Drainage Improvements Project - Joy Jones, P.E., Public Works Department Director

That the Board take the following action concerning United States Department of Homeland Security (USDHS), Federal Emergency Management Agency (FEMA), and Florida Division of Emergency Management (FDEM) Hazard Mitigation Grant Program (HMGP) Federally-Funded Subaward and Grant Agreement #18HM-H4-01-27-01-XXX, Project #4177-19-A, from the Florida Division of Emergency Management (FDEM), for the construction of the Lake Charlene Drainage Improvements Project:
 
A. Approve and Authorize the Chairman to execute Federally-Funded Subaward and Grant Agreement #18HM-H4-01-27-01-XXX, Project #4177-19-A, for the construction of the Lake Charlene Drainage Improvements Project; and
 
B. Authorize the Chairman to execute, subject to Legal review and sign-off, any subsequent Agreements and program-related documents for this project that do not alter the finite terms of funding amounts or budgets.
 
The County Attorney's Office has requested that the Board be made aware of the following language within the Agreement: Section (22) Mandated Conditions, subsection (b), that "This Agreement shall be construed under the laws of the State of Florida, and venue for any actions arising out of this Agreement shall be in the Circuit Court of Leon County."

This project is located in Commission District 2. 
BACKGROUND:
At the regular scheduled Board of County Commissioners (BCC) meeting on November 6, 2014, the Lake Charlene Area of the Warrington Basin Study, PD 13-14.081, was awarded to HDR Engineering, Inc. by the BCC. HDR’s task order included a study and grant application for this proposed mitigation project, with the goal to modify existing stormwater facilities and infrastructure to increase efficiency, add capacity and improve conveyance within the drainage area. At the regularly scheduled BCC meeting on December 11, 2014, the board approved submittal of this project for HMGP funding consideration. HDR submitted the HMGP application on March 6, 2015. FDEM awarded the design phase grant and the BCC approved the grant agreement on June 16, 2016. That HMGP grant agreement provided for reimbursement funding for $314,274.00 for the Phase 1 design phase of the project. At the regularly scheduled meeting on August 4, 2016, the BCC approved a design scope change order with HDR for $295,181.73 to complete design plans specified in the grant.
 
Design deliverables were submitted to FDEM on January 6, 2015 for review, less regulatory permits. All permits from the Army Corps of Engineers (ACOE), FDEP, and Florida Department of Transportaion (FDOT) have since been approved for the project, with the most recent approval by FDOT. FDEM has reviewed all design deliverables and approved Phase 2 construction, to be funded by this HMGP grant agreement.
 
The project will resolve repetitive flooding problems that have occurred since the 1970's affecting 266 homes and generating a loss of roadway function for up to 48 hours during rain events. All project activities will be executed in compliance with applicable codes and regulations. The completed project shall provide protection against a 50-year storm event per grant requirements, protect 75 structures from flooding, and reduce flooding frequency for 266 properties during a 100-year storm event. This project will improve stormwater management systems in the associated drainage area and prevent or reduce future flood damage similar to what was experienced in the April 2014, June 2012, April 2005, September 1998, and other severe storm events.

This grant agreement is 100% federally funded for Phase 2 construction improvements for $2,101,252.00. Funding match was leverage as a global match under the Beach Haven Northeast Phase 1 project. The agreement period of performance for construction extends to March 31, 2020. 
 
Phase II construction proposes to construct approximately 1,635 feet of double 60-inch concrete pipe to 61st Avenue, 813 feet of 66-inch pipe and an additional 110 feet of 60-inch pipe to the final outfall located south of US 98.
 
The Lake Charlene area was developed from 1961 to 1994. In response to a March 1979 flooding event, a 30” pipe with sluice gate was installed by the developer, parallel to a 43”x64” elliptical corrugated metal outfall pipe (ECMP); the 30” corrugated metal pipe (CMP) was placed at a lower elevation so that Lake Charlene Home Owners Association (LCHOA) could manually lower the lake elevation by 2 feet and provide additional lake capacity to a lower flood stage.

Escambia County provided several drainage improvements in the basin, starting in 1992 with the 61st Avenue Pond to manage runoff from the neighboring ballpark and 61st Avenue and in 2001 with the two (2) Myrtle Hill Circle-Ballparks stormwater retention ponds. In 2006 the 1979 Sluice Gate and 2 CMP’s deteriorated and the County replaced them with the current 66” outfall pipe and existing sluice gate. 
  
Other projects in the basin following the 2006 sluice gate project, include the 2012 Lago Vista & 72nd Avenue whereby an existing failed CMP cross drain was replaced, and a stormwater storage area was added on the west side of 72nd Avenue for flooding reduction of several Lago Vista apartment units. In 2013 and 2014, Myrtle Grove Ballpark Park improvements including paving of dirt parking areas, and 4 additional stormwater retention ponds were constructed to handle the 25-year storm event and reduce downgradient impacts to Lake Charlene. In 2014, the Lake Charlene Outfall Ditch Project included regrading and lining of the outfall ditch to prevent vegetation overgrowth and improve outflow capacity.

Staff held two separate public meetings, one in August 2015, and one in April 2017. In response to concerns expressed by the home owners at the April 2017 public meeting, the County initiated the design of the “Lake Charlene Sediment Catchment” project. Plans are complete and this feature will also be bid as a treatment unit in line to the existing 60” inflow pipe to Lake Charlene on the West side of the Lake.
BUDGETARY IMPACT:
Funding for the project is 100% federal funding, due to leveraged funds from Beach Haven Northeast Phase 1 Project that provides 100% federal funding as a global match, under FDEM non-financial agreement #FDEM No. 16NF-00-01-27-01-453, for all Escambia County 4177 disaster declaration HMGP projects.
LEGAL CONSIDERATIONS/SIGN-OFF:
The County Attorney’s Office has reviewed the agreement and signed-off for legal sufficiency, and has requested that the board be made aware of the agreement language in Section 22, Mandated Conditions, Subsection (b) that, “This Agreement shall be construed under the laws of the State of Florida, and venue for any actions arising out of the agreement shall be in the Circuit Court of Leon County.”   
PERSONNEL:
Public Works Department / Engineering Division staff will manage this grant. Legal staff will also be necessary to acquire the drainage easement from the Lake Charlene Home Owners Association for the project construction to proceed.
POLICY/REQUIREMENT FOR BOARD ACTION:
Board policy Section 11.A requires Board approval of grants.
IMPLEMENTATION/COORDINATION:
Public Works Department / Engineering Division staff will also administer the grant, as required by the contract agreement, and will coordinate with the County Attorney’s Office for easement acquisition from the Lake Charlene Home Owners Association for this project.
