RECOMMENDATION:
Recommendation Concerning the Access and Construction Agreement with Pensacola State College for the Jones Swamp Floodplain Restoration & Expansion Project - J. Taylor "Chips" Kirschenfeld, Director, Department of Natural Resources Management

That the Board take the following action concerning the Access and Construction Agreement with Pensacola State College for the Jones Swamp Floodplain Restoration & Expansion Project:

A. Approve the Access and Construction Agreement (College Contract Number 2019076) between the District Board of Trustees of Pensacola State College, Florida, and Escambia County; and

B. Authorize the Chairman to sign the Agreement and any subsequent documents related to acceptances, execution, reporting, no-cost time extension, and Amendments to this Agreement, subject to Legal review and approval, without further action of the Board.
BACKGROUND:
Escambia County Department of Natural Resources Management is planning a Jones Creek Floodplain Restoration Project funded by the National Fish & Wildlife Foundation as part of the Bayou Chico Restoration Grant approved by the Board on 07-23-2015 [Funding: Fund 118, Gulf Coast Restoration Fund, Cost Center 222002, NFWF #45910 Bayou Chico]. 
 
The project will restore more than 10 acres of the historic Jones Creek floodplain by removing fill material associated with a former runway clearway south of U.S. Highway 98.  The restoration site is located on property owned by Pensacola State College (PSC) adjacent to the Warrington campus.  The Board approved a Revocable License Agreement with PSC on 01-07-2016 that allowed county staff and contractors to access the restoration site in order to conduct environmental testing, soil borings, and prepare the design for the project.  All the work allowed by this initial agreement has been completed.  The design is nearing completion, and is expected to be ready to bid fall 2018.  This Access and Construction Agreement will allow for the construction of the project on PSC property. Grant funding for design and construction has already been secured. Grant does not require matching funds for the Jones Creek floodplain portion of the project.
BUDGETARY IMPACT:
No budgetary impact associated with this recommendation.

The Agreement was prepared by Stephen G. West, Senior Assistant County Attorney.
PERSONNEL:
Department of Natural Resources Management staff will manage this project.
POLICY/REQUIREMENT FOR BOARD ACTION:
Board Policy II.B.8.
IMPLEMENTATION/COORDINATION:
An original document executed by Pensacola State College on 08-21-2018 has been provided for consideration.  The Department of Natural Resources Management will ensure the fully executed original is provided to the Clerk’s Office for the record, and one certified copy is provided to PSC.  Implementation of this agreement will be coordinated through the Department of Natural Resources Management.
