RECOMMENDATION:
Recommendation Concerning the Single Patient Agreements for Fresenius Kidney Care for Dialysis Services and Delegation of Signatory Authority to Dr. Rayme Edler, Escambia County Medical Director - William R. Powell, Director of Corrections

That the Board take the following action:

A. Approve the additional paragraph that Fresenius Kidney Care has requested to add to the previously approved Single Patient Agreement for Dialysis Services Agreement required by treating facilities; and

B. Authorize Dr. Rayme Edler, Escambia County Medical Director, to sign the Single Patient Agreements for Fresenius Kidney Care.
BACKGROUND:
On 7/5/2018, the Board approved the Single Patient Agreements for Inmate Dialysis Services. This action was taken because individual treatment facilities that provide dialysis services to the inmates of the Escambia County Jail require a Single Patient Agreement to be signed. This Agreement covers the treatment of the corresponding inmate only for the period during which they are incarcerated under the jurisdiction of Escambia County. In order to expedite the return of the requested Single Patient Agreements to the treatment facility, the Corrections Department requested authorization for Dr. Rayme Edler, Escambia County Medical Director, to sign the referenced Agreements.

On 10/7/2020, Fresenius Kidney Care requested to update the language in the Single Patient Agreement by adding a paragraph to comply with the international Foreign Corrupt Practices Act. Below is the requested update:

"As Stated in the Fresenius Medical Care Code of Ethic and Business Conduct, Provider upholds the values of integrity and lawful conduct, especially with regard to anti-bribery and anti-corruption. Provider upholds these values in its own operations, as well as in its relationships with business partners. Provider's continued success and reputation depends on a common commitment to act accordingly. Together with Provider, Payor is committed to uphold these fundamental values by adherence to applicable laws and regulations."
 
BUDGETARY IMPACT:
There is no additional financial impact related to the requested change to the Single Patient Agreements for Fresenius Kidney Care.
LEGAL CONSIDERATIONS/SIGN-OFF:
The approved Single Patient Agreement is provided along with the Single Patient Agreement with the additional paragraph. These Agreements have been reviewed and approved for utilization by Kristin Hual, Senior Assistant County Attorney.
PERSONNEL:

POLICY/REQUIREMENT FOR BOARD ACTION:
Designation of Signatory authority and additional language must be approved by the Board of County Commissioners.
IMPLEMENTATION/COORDINATION:
Upon approval, the Jail's health services section will coordinate with the Fresenius treatment facilities to provide them with the approved agreement for utilization.
