RECOMMENDATION:

Recommendation Concerning Settlement of Esc. Co. adv. CEJ South, Inc., Case No. 2014 CA 002270 & Esc. Co. v. CEJ South, Inc. d/b/a Family-Funeral & Cremation, Case No. 2020 CA 000787.

That the Board authorize the Chairman to sign the settlement agreement regarding the pending litigation between Escambia County and CEJ South, Inc.

BACKGROUND:

The Board met in attorney/client session and authorized a settlement in which CEJ South, Inc. and Escambia County would resolve the pending litigation between them by dismissing each of their cases against the other and entering into the attached settlement agreement. The settlement agreement provides that CEJ South, Inc., d/b/a Family-Funeral and Cremation will be responsible for paying cremation user fees for private cremations from July 1, 2020, and continuing. As part of the settlement, CEJ South, Inc. will dismiss with prejudice its claim against Escambia County relating to the siting of its crematorium.
