RECOMMENDATION:

Recommendation Concerning Authorization for Substitution as Counsel by Escambia County Attorney Office for Lydecker Diaz Law Firm in Andrea Minyard, M.D. v. Esc. Co., Case No. 3:20-00034-TKW/EMT.

That the Board authorize the County Attorney's Office to substitute as counsel for Escambia County in place of Lydecker Diaz Law Firm in this pending matter.

BACKGROUND:

Chubb Insurance Company, provided public entity liability coverage for Escambia County. Escambia County, along with the other three counties comprising District 1, was sued by Andrea N. Minyard, M.D., the former Interim Medical Examiner because of alleged violation of the Equal Pay Act. She is claiming that the Boards comprising District 1 approved a contract with Dr. Timothy Gallagher to pay him $325,000.00 per year in compensation as Interim Medical Examiner, after Dr. Minyard resigned her position effective September 30, 2019, constitutes a violation of the Equal Pay Act on the basis of gender, as she was paid $250,000.00 per year. Chubb denied coverage because of exclusions that Dr. Minyard is part of a law enforcement or is part of health care operations which are excluded under the policy. As to the Equal Pay Act claim, Escambia County denies that it or any other county employed Dr. Minyard and that she was an independent contractor.

This office will undertake a vigorous defense of the Equal Pay Act claim and will seek to obtain a final summary judgment in favor of Escambia County.
