Recommendation Concerning the Contract Award for the Commercial Demolition of 7220 Plantation Road - Chips Kirschenfeld, Director, Natural Resources Management through Paul Nobles, Purchasing Manager, Office of Purchasing

That the Board approve and authorize the County Administrator to sign the Agreement between Escambia County, Florida, and Larry Gates Construction, Inc., per the terms and conditions of PD 19-20-088, Commercial Demolition of 7220 Plantation Road.

BACKGROUND:
The property located at 7220 Plantation Road is a hotel on a commercial parcel that has been owned by Park Avenue Hotel Group Florida, LLC, since 2017 and became a source of nuisance complaints which are affecting the neighboring commercial properties. A Notice of Violation (CE19084055U) was issued on August 7, 2019. This property is located just to the east of Interstate 110, and west of Plantation Place Townhomes. The north side of the parcel abuts Super 6 Inn & Suites Hotel, and the south side abuts a parcel containing a cell phone tower. The property is centered in between Interstate 110 and Plantation Road.

The property is not being maintained in accordance with the nuisance codes 42-196 (a), (b), and unsafe structure codes 30-203 (n), (p), (t), (u), (x), and (cc). The building is in disrepair and open to the elements, with broken windows, dilapidated siding, a roof not structurally sound, exterior doors open or not weather tight, and a non-functioning swimming pool which is not properly secured. The building is a safety hazard.

After proper notices and due process, the owners of the property were noticed to appear before the Special Magistrate, and ordered to comply with all cited conditions, otherwise face fines and costs. Representative Sunil Mir from Park Avenue Hotel Group Florida LLC, now a dissolved company, appeared at the hearing however, has failed to make any attempts to clear the violations. A Special Magistrate Order was issued on March 10, 2020, regarding the nuisance and unsafe structure conditions. The property continues to worsen since the investigation began. 

Escambia County Code Enforcement has elected to solicit contractor pricing in order to take action to bring the parcel into compliance, as provided in the Special Magistrate Order. The Contract will consist of demolition and legal disposal of the structure, and crushing and filling in the defunct swimming pool, as well as clearing the parcel of all existing nuisance conditions. The cost of the cleanup, along with daily fines that began on May 10, 2020, at $50 per day and court fee of $235, will be filed as a lien on the parcel after it is abated.

An Invitation to Bid for PD 19-20.088, Demolition of 7220 Plantation Road, was publicly noticed to 172 firms via Vendor Registry on August 19, 2020. A Mandatory Pre-bid meeting was conducted at the job site on August 24, 2020, with 10 firms attending. One bid was received. Larry Gates Construction, Inc., was the only bid received.

POLICY/REQUIREMENT FOR BOARD ACTION:
This Recommendation is in compliance with the Code of Ordinances of Escambia County, FL 1999, Chapter 46, Finance, article II Purchases and Contracts.
IMPLEMENTATION/COORDINATION:
The Office of Purchasing will issue the Standard Form of Contract, Form B, Construction as well as the Purchase Order.
