RECOMMENDATION:
Recommendation Concerning Amending Resolution R2019-60 Establishing a User Fee for Cremation Authorization Services by Medical Examiner. 

That the Board take the following action:
A. Amend Resolution R2019-60 establishing a user fee for cremation authorization services rendered by District I Medical Examiner; and

B. Adopt and authorize the Chairman to sign Amended Resolution which provides for a retroactive date to collect the user fees.
BACKGROUND:
At its regular meeting on July 18, 2019, the Board adopted R2019-60, which established a user fee for cremation authorization services rendered by the District I Medical Examiner to funeral homes and cremation facilities. The former Medical Examiner had previously announced her intention not to collect cremation authorization fees beginning October 1, 2018.  Although the Board authorized the collection of a user fee by the County, there were some funeral homes which did not remit user fees beginning October 1, 2018 asserting that R2019-60 was not retroactive.  This amended resolution makes clear that the user fee is to be collected retroactively to October 1, 2018.
BUDGETARY IMPACT:
Beginning October 1, 2018, the Board will collect user fees for the services of the District I Medical Examiner to authorize cremations to take place.  The user fees lessen the financial burden of budgeted District I Medical Examiner operations where cremations benefit a segment of the particular population who chose to cremate the remains of family members and loved ones.
