RECOMMENDATION:
Recommendation Concerning the Surplus and Sale of a Portion of County-Owned Real Property Located at Merritt Street - Stephan Hall, Budget Manager, Management and Budget Services

That the Board take the following action concerning the surplus and sale of a portion of County-owned real property located at Merritt Street:

A. Upon written request by the County Administrator, authorize the County Attorney's Office to take such action necessary to evict occupants of the County-owned property;

B. Declare surplus the portion of the Board's real property, located at Merritt Street (as shown on the Boundary Survey - Exhibit A), located in District 2; Account #:  08-1366-000; Reference #:  50-2S-30-5090-014-001; Property Appraiser's current assessed value:  $2,100;

C. Authorize the sale of the property to the bidder with the highest offer received at or above the minimum bid, which will be set at the Property Appraiser's current assessed value.  It has been determined that the County does not have a need for this property; and

D. Authorize the County Attorney's Office to prepare, and the Chairman to sign, all documents related to the sale of this property, without further action of the Board.
BACKGROUND:
The property located at Merritt Street (Account #:  08-1366-000; Reference #:  50-2S-30-5090-014-001), better described as:  LT 14 LESS DITCH BLK 1 OR 1665 P 323 DURCHSLAGS S/D PB 1 P 44 SEC 50/51 T 2S R 30 ACCORDING TO FL STATUTE 197.502(8) CA 216, escheated to the County on July 12, 1982.

On September 12, 2019, the County received an email from Attorney Edmund Holt stating that his office represents the Estate of the adjacent owner (Lot 13), and that the estate owns a home on that lot, which was built in 1938 and added onto over the years.  In the process of selling the estate, it was discovered that the edge of the home encroaches over the boundary line onto Lot 14 (owned by Escambia County via the 1982 Tax Deed).  A large drainage ditch bisects the County-owned lot at an angle with the larger triangle of the parcel adjacent to his client's property.  

Request has been made for the County to have the large triangular piece of the aforementioned parcel (as shown on the Boundary Survey - Exhibit A) deemed as surplus and be made available for either the Estate, to be included in the estate's sale to the buyer, or to the buyer himself. A copy of Mr. Holt's request is attached for review.

The portion of the subject property (as shown on Boundary Survey - Exhibit A) has been reviewed by County departments, and it has been determined that the County does not have a need for this property. The property will be sold via online public auction to the bidder with the highest offer received at or above the minimum bid, which will be set at the Property Appraiser's current assessed value in accordance with Escambia County Code of Ordinances, Section 46.134.
BUDGETARY IMPACT:
Sale of this property will provide revenue for the General Fund.
LEGAL CONSIDERATIONS/SIGN-OFF:
The County Attorney's Office will prepare or approve all legal documents prior to execution by the Chairman.
