RECOMMENDATION:
Recommendation Concerning the Scheduling of a Public Hearing to Consider the Vacation of an Opened Right-of-Way Known as Cameron Lane - Joy Jones, P.E., Engineering Department Director

That the Board schedule a Public Hearing for December 5, 2019, at 5:31 p.m., to consider the Petition to Vacate a private right-of-way known as Cameron Lane, as petitioned by VWSS American, LLC.:

A.  Authorize the scheduling of a Public Hearing for December 5, 2019, at 5:31 p.m., to consider the Petition to Vacate a private right-of-way known as Cameron Lane (0.44 acres, more or less), as petitioned by VWSS American, LLC.; and

B. Require the Petitioner to notify all property owners within a 500-foot radius.

The real property mentioned in this Petition to Vacate is located in Commission District 2.
BACKGROUND:
The Petitioner recently purchased the property to the north and to the south of Cameron Lane. The property to the north of Cameron Lane is presently used as a storage facility with self-storage units. The property to the south of Cameron Lane is presently used for outside storage of boats, vehicles, trailers, and motor homes. 

Prior to the Petitioner purchasing the property, the Petitioner's attorney, Thomas Balmat, had inquired if Cameron Lane was a private road or a County-maintained road. There were no records of Cameron Lane being maintained by Escambia County. To clear up the title, the Petitioner is going through the Petition to Vacate process. 

On August 27, 2019, County staff met to discuss the status of Cameron Lane, and to review a Right-of-Way Easement from The United States Postal Service to Escambia County, Florida, dated November 1, 1990, recorded in Official Records Book 2978, Pages 647-650. The Easement was conveyed to the County "for public road or highway purposes, so long as the same shall be used, operated, and maintained as a public road or highway." It has been determined that the County is not currently, nor has it ever maintained Cameron Lane in the past, which makes it a private road. 

Staff has no concerns with this Petition to Vacate since Cameron Lane is a private roadway. 

Gulf Power and Peoples Water Service Company of Florida, Inc. have Easements in the area of Cameron Lane which they want to retain.
BUDGETARY IMPACT:

Indirect staff cost associated with the preparation of documents and recommendation.

LEGAL CONSIDERATIONS/SIGN-OFF:

N/A

PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:

Based on the Board’s Vacating, Abandoning, and Closing Existing Public Streets, Rights-of-Way, Alleyways, Roads, Highways, Other Places Used for Travel or Other Lands Dedicated for Public Use or Purposes, or Any Portions Thereof to Renounce and Disclaim Any Right of the County and The Public In and To Said Lands policy for closing, vacating and abandoning County owned property – Section III and Florida Statutes, Chapter 336.

IMPLEMENTATION/COORDINATION:

Once the Public Hearing has been scheduled, the Petitioner will be notified, the date and time will be advertised, and all owners of property within 500 feet will be notified.
