Discussion Concerning Code Enforcement Special Magistrate Hearing Costs - J. Taylor "Chips" Kirschenfeld, Natural Resources Management Department Director

That the Board discuss the Code Enforcement Special Magistrate "hard cost" assessment of $1,100 per hearing, in context with the May 7, 2008, Second District Court of Appeal ruling Stratton v Sarasota County.

BACKGROUND:

The administrative hard cost for Special Magistrate hearings was developed in 2006. The calculation included the total cost of labor, operation, overhead, and equipment for one year and divided by the number of cases heard to reach the per case average of $1,100. At its October 19, 2017 meeting, the Board approved a Schedule of Costs that works with an adjustable fee schedule. Additionally, the Board directed this item be brought forward at the November 2, 2017 meeting for further discussion.
