RECOMMENDATION:
5:31 p.m. Public Hearing for consideration of the Petition to Vacate a Portion of Unopened Right-of-Way Known as Rentz Avenue, as petitioned by Michele Mayfield Slowey-Blankenship.

That the Board take the following action concerning the Petition to Vacate a Portion of Unopened Right-of-Way Known as Rentz Avenue:
  
A. Approve or deny the Petition to Vacate a Portion of Unopened Right-of-Way Known as Rentz Avenue (approximately 0.40 acres), as petitioned by Michele Mayfield Slowey-Blankenship;

B. Accept the Hold/Harmless Agreement;

C. Adopt the Resolution to Vacate; and

D. Authorize the Chairman or Vice Chairman to accept the documents as of the day of delivery of the documents to the Chairman or Vice Chairman, and authorize the Chairman or Vice Chairman to execute them at that time.

The real property mentioned in this Petition to Vacate is located in Commission District 2.
BACKGROUND:
This portion of Rentz Avenue is an unopened right-of-way located on the south side of Gulf Beach Highway. The Petitioner's family has owned the property located at 2531 Gulf Beach Highway since 1951, and the Petitioner is requesting that the County vacate a portion of the unopened right-of-way west of her property known as Rentz Avenue (approximately 0.40 acres).  Petitioner's recent survey of the property show the driveway and fence encroach into this portion of unopened right-of-way.

Staff has reviewed the request and there are objections to this request since the ongoing Beach Haven Drainage Project may need to utilize the existing right-of-way for infrastructure. Planning and Zoning staff noted that the subject area serves as a buffer between this property’s residential zoning and the heavy commercial/light industrial zoning to the west. Should that adjacent parcel be later developed for commercial use, buffering will be required of the developer of the commercial-use property.

Emerald Coast Utility Authority (ECUA) has no infrastructure in the subject area; however, they would like to retain a Utility Easement for potential future sewer expansion projects along Gulf Beach Highway. Gulf Power will need an Anchor Easement for the subject area.  AT&T, MCI, Peoples Water Service, Quanta Telecommunication Services, and Pensacola Energy state that they have no objections to this Petition to Vacate.
BUDGETARY IMPACT:

Indirect staff cost associated with the preparation of documents and recommendation.

LEGAL CONSIDERATIONS/SIGN-OFF:

Not Applicable.

PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:

This recommendation is based on the Board's Vacating, Abandoning, and Closing Existing Public Streets, Rights-of-Way, Alleyways, Roads, Highways, Other Places Used for Travel or Other Lands Dedicated for Public Use or Purposes, or Any Portions Thereof to Renounce and Disclaim Any right of the County and The Public In and To Said Lands policy for closing, vacating and abandoning County Owned property- Section III, and Florida Statues, Chapter 336.

IMPLEMENTATION/COORDINATION:

Upon Board approval of the Petition to Vacate, the necessary documents will be signed and delivered to the Petitioner or the Petitioner's agent, who will have them recorded in the public records and will have notices published.
