RECOMMENDATION:
Recommendation Concerning Final Plat Bentley Oaks Unit 6 Permit #PSD150900038

That the Board take the following action concerning recording of Bentley Oaks Unit 6 (a 33-lot residential subdivision), located in the Cantonment Community and lying west of County Road 297A and north of W. Kingsfield Road. Owned and developed by Beaird Development, LLC.  Prior to recording the County Surveyor  and the Clerk of the Circuit Court must sign the Final Plat as set forth in Section 2-5.7, of the Escambia Land Development Code; also, prior to recording the County Surveyor must sign the Final Plat as set forth in Chapter 177.081 (1) Florida Statute;

A. Approve the final plat for recording;

B. Approve the street names “Kahuna Way and Bentley Oaks Drive”;

C. Accept all public easements, drainage improvements within public easements as depicted upon the final plat for permanent County maintenance; the cost of maintenance is to be funded through the establishment of a storm water management Municipal Services Benefit Unit (MSBU); and

D. Authorize the Chairman or Vice Chairman to execute a Release of Claims for Damages, Hold Harmless, and Indemnification Agreement and a Two-Year Warranty Agreement without Surety, for Streets and Drainage improvements.
BACKGROUND:
The preliminary plat and construction plans were approved on March 30, 2016. The Escambia County Public Safety Department approved the street names “Kahuna Way and Bentley Oaks Drive” on June 21, 2006.  Development Services Department inspected the improvements on October xx, 2017 and found improvements substantially complete and in accordance with applicable County Requirements. An executed Two Year Warranty Agreement without Surety will be recorded with the Final Plat. Staff has reviewed the final plat.
LEGAL CONSIDERATIONS/SIGN-OFF:
This recommendation is consistent with previous practices of the County Attorney’s Office. The Two Year Warranty Agreement without Surety was reviewed and approved by Stephen West on xxx xxx, 2017. The Release of Claims for Damages, Hold Harmless, and Indemnification Agreement was reviewed and approved by _____ on xx xx 2017.
PERSONNEL:
All work associated with this recommendation was done in-house and no additional staff was required. Future Road Department budgets will reflect additional cost to maintain these improvements, if any.
POLICY/REQUIREMENT FOR BOARD ACTION:
Based on the County Land Development Code – providing procurement for surety to warrant subdivision improvements (Ord. #2002-9) and the Florida State Plat Act - Chapter 177.
IMPLEMENTATION REQUIREMENTS:
Once the final plat has been approved by the Board and final sign-offs given by the County Engineer, County Surveyor and Development Services Department Director, it will be transmitted to the Clerk of Court’s Office for recording in the public records of Escambia County, Florida.
COORDINATION WITH OTHER AGENCIES/PERSONS:
Staff has been in contact with the developer’s engineer/surveyor, County Road Department, County Building Inspections and Development Services Department.
