RECOMMENDATION:
Recommendation Concerning the Second Amendment to the Interlocal Agreement for Reciprocal Evacuation and Re-Entry Among the City of Orange Beach, Alabama; Escambia County, Florida; and the Escambia County, Florida Sheriff's Department - Michael D. Weaver, Public Safety Department Director

That the Board take the following action concerning the Second Amendment to the Interlocal Agreement for Reciprocal Evacuation and Re-Entry Among the City of Orange Beach, Alabama; Escambia County, Florida; and the Escambia County, Florida Sheriff's Department:

A.  Approve the Second Amendment to the Interlocal Agreement; and

B. Authorize the Chairman to sign the Agreement. 
BACKGROUND:
The parties previously entered into an Interlocal Agreement for Reciprocal Evacuation and Re-Entry approved by the Board January 18, 2008 and a First Amendment updating the Agreement May 5, 2016 to allow for and facilitate reciprocal evacuation and post-evacuation re-entry of Perdido Key, Florida and the City of Orange Beach, Alabama. 

Based upon local plan review and discussions, it has been decided to remove specific and inconsistent language within this interlocal agreement, which identified an evacuation re-entry vehicle window sticker program maintained only for Perdido Key and Pensacola Beach. That window sticker program, designated only for the county's barrier islands creates inconsistency in how the county manages evacuation re-entry operations throughout the remainder of the county.  In an effort to consolidate the evacuation re-entry plan with uniformity in operations, and consistency in application throughout the county, all of the language referencing the window sticker program is being removed from the the interlocal agreement and the window sticker program will be terminated upon Board approval.

LEGAL CONSIDERATIONS/SIGN-OFF:
Kristin Hual, Assistant County Attorney, has reviewed and approved the interlocal agreement as to it's form and legal sufficiency.

POLICY/REQUIREMENT FOR BOARD ACTION:
The Board requires all interlocal agreements to be reviewed and approved by it.
IMPLEMENTATION/COORDINATION:
John Dosh, Division of of Emergency Management Manager, will be responsible for the coordination and implementation of the agreement in cooperation with the City of Orange Beach, Alabama and the Escambia County, Florida Sheriff's Department.
