RECOMMENDATION:

Recommendation Concerning the Settlement Agreement and General Release of all Claims for the M.C. Blanchard Water Damage Claim - Robert Dye, Manager, Risk Management Office

That the Board approve, and authorize the Chairman to sign, the Settlement Agreement and General Release of all Claims, in the amount of $842,774.77, less prior advance payments of $516,000.00, for a total remaining final settlement amount of $326,774.77, for the M.C. Blanchard water damage claim that occurred on November 29, 2016.

BACKGROUND:

The M.C. Blanchard building sustained water damage on November 29, 2016. The damage resulted from a gasket failure in the sprinkler system years after installation. There was minimal physical damage to the building. The leak caused a large amount of water to be discharged onto the floor of the records room that was adjacent to a vault that housed microfiche and microfilm records maintained by the Clerk’s Office. Elevated humidity and heat created damaging conditions for microfiche and film stored in the vault. The insurer provided coverage for the damaged records, and a lengthy process of converting the media to digital format began. The Clerk’s Office agrees with the settlement and has requested that any funds remaining from the settlement be allocated for digital storage.

BUDGETARY IMPACT:

Insurance proceeds will be deposited into Fund 501.

The release was reviewed by Charlie Peppler, Deputy County Attorney.
