RECOMMENDATION:
Recommendation Concerning a Site Access Agreement with the State of Florida, Department of Environmental Protection to Conduct an Environmental Assessment at 1316 North "P" Street - J. Taylor "Chips" Kirschenfeld, Director, Department of Natural Resources Management

That the Board take the following action concerning the Site Access Agreement for the property at 1316 North "P" Street:

A. Approve the Site Access Agreement to allow the State of Florida, Department of Environmental Protection (FDEP) to locate contamination, determine contamination levels, and, when necessary, remove and remediate contamination which may be performed by the FDEP and its contractor; and

B. Authorize the Chairman to sign the Agreement and subsequent documents related to the project, subject to Legal review and sign-off.
BACKGROUND:
From circa 1950s to circa 1970s, the property located at 1316 N P Street was used as a Texaco service station.  It was reported the associated underground storage tanks (UST) were removed in January 1995 and that petroleum contamination was documented at that time. The property was entered into the State Abandoned Tank Restoration Program (ATRP). However, the funding score given to the site was above the program cleanup score at that time and the site was put on hold until funding became available. The funding is now available to conduct assessment and remediation at the property.  This Site Access Agreement will provide the State access to the property to conduct the work.
BUDGETARY IMPACT:
There is no budgetary impact associated with this recommendation.
LEGAL CONSIDERATIONS/SIGN-OFF:
The Site Access Agreement was reviewed and approved as to legal sufficiency by Stephen West, Senior Assistant County Attorney.
PERSONNEL:
There is no personnel impact associated with this recommendation.
POLICY/REQUIREMENT FOR BOARD ACTION:
Board Policy II.B.8.
IMPLEMENTATION/COORDINATION:
The Brownsfields Coordinator along with Department of Natural Resources Management staff will coordinate with applicable parties to implement the terms of the Agreement.
