RECOMMENDATION:
Recommendation Concerning the Scheduling of a Public Hearing to Consider the Petition to Vacate a Drainage Easement Located Between 12980 and 12990 Ogden Drive, on the Board's Own Motion - Joy D. Blackmon, P.E., Public Works Department Director

That the Board authorize the scheduling of a Public Hearing for February 15, 2018, at 5:31 p.m., to consider the vacation of a 20-foot-wide drainage easement located between 12980 and 12990 Ogden Drive, on the Board's own motion:

A. Schedule a Public Hearing for February 15, 2018, at 5:31 p.m., to consider the vacation of a drainage easement located between 12980 and 12990 Ogden Drive; and

B. Direct staff to notify all property owners within a 500-foot radius or all properties using Ogden Drive, Rosirito Place, and Tracy Road for access.
BACKGROUND:
On August 26, 1997, the Board authorized staff to proceed with obtaining easements and/or property needed to construct road and drainage improvements along sixty-six county roads, including Ogden Drive. A 20 foot wide drainage easement was required, and the property owners donated a 15 foot wide drainage easement, located on the east side of the property line at 12990 Ogden Drive. The remaining 5 feet were obtained from the adjacent lot, 12980 Ogden Drive. 

During the Hartung-Ogden Drainage Project in 2010, the pipe previously installed in this drainage easement, no longer necessary for proper drainage, was closed off. Staff recommends that the Board vacate the abandoned drainage easement as it no longer serves a public purpose.  

Upon Board approval of this vacation, staff will notify all owners of property within the specified area of the drainage easement. 
BUDGETARY IMPACT:

Indirect staff cost associated with the preparation of documents and recommendation.

LEGAL CONSIDERATIONS/SIGN-OFF:

N/A

PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:

Based on the Board’s Vacating, Abandoning, and Closing Existing Public Streets, Rights-of-Way, Alleyways, Roads, Highways, Other Places Used for Travel or Other Lands Dedicated for Public Use or Purposes, or Any Portions Thereof to Renounce and Disclaim Any Right of the County and The Public In and To Said Lands policy for closing, vacating and abandoning County owned property – Section III and Florida Statutes, Chapter 336.

IMPLEMENTATION/COORDINATION:

Once the Public Hearing has been scheduled, the date and time will be advertised, and all owners of property within the specified area will be notified. It will be the responsibility of county staff to place the advertisement and notify property owners.
