Issue:    Acceptance of a Drainage Easement for the Mayfair-Algiers Drainage Improvement Project

RECOMMENDATION:
Recommendation Concerning the Acceptance of a Drainage Easement for 4551 Bridgedale Road - Joy D. Blackmon, P.E., Public Works Department Director

That the Board take the following action concerning the acceptance of a drainage easement (approximately 0.05 acres) from Alfred L. Bush and Marsha G. Bush, for property located at 4551 Bridgedale Road:

A. Accept the donation of a drainage easement (approximately 0.05 acres) located at 4551 Bridgedale Road, from Alfred L. Bush and Marsha G. Bush, for drainage improvements;

B. Authorize the payment of documentary stamps considering the property is being donated for governmental use for drainage improvements, and the County benefits from the acceptance of this property, which enhances the safety and well-being of the citizens of Escambia County;

C. Authorize the payment of incidental expenditures associated with the recording of the Drainage Easement document; and

D. Authorize the Chairman or Vice Chairman to accept the Drainage Easement as of the day of delivery to the Chairman or Vice Chairman, and authorize the Chairman or Vice Chairman to acknowledge the Board's acceptance at that time.

BACKGROUND:
On August 3, 2017, the Board accepted a drainage easement from Mr. and Mrs. Bush for the Mayfair-Algiers Drainage Improvement Project. The previously accepted drainage easement is located along the south property line of 4551 Bridgedale Road.  That easement was to allow the County to install a new pipe to replace the deteriorating pipe that was failing. 

Upon further evaluation, there were utility conflicts in the area where the new pipe was to be placed and the existing pipe was too damaged to be filled properly. Additionally, the existing pipe also led to holes in the property owner's yard, causing safety concerns. The pipe must now be removed and replaced with a reinforced concrete pipe. The new donated drainage easement, that runs diagonally across the southeast corner of the property, will be used to access and replace the failed stormwater pipe.  The construction area will then be restored and stabilized.This pipe ties into the existing system at a manhole in the easement between Algiers Street and Waltham Street. It is a continuation of Phase I and II pipe replacement of the Mayfair-Algiers Drainage Improvement Project.
BUDGETARY IMPACT:
Funds for the project are available in  Fund 352 LOST III, Account Code 210107/56301, Project #16EN3542 "Mayfair/Algiers".
LEGAL CONSIDERATIONS/SIGN-OFF:
The Drainage Easement was approved as to form and legal sufficiency by the County Attorney's office.
PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:
These actions are consistent with the provisions of Section 46-139 of the County Code of Ordinances.
IMPLEMENTATION/COORDINATION:
Upon Board approval, staff will proceed in compliance with Section 46-139 of the County Code of Ordinances.
